To Approve Applications for Annexation of Adjoining Territory

December 1, 2001

WHEREAS, the City Council at a special meeting on November 17, 2001, received applications for voluntary annexation of territory comprising 442.23 acres approximately including the remainder of the Maharishi Center for Perfect Health and World Peace subdivision (“Maharishi Center”) not already included within the boundaries of the City, and a 2.13-acre parcel used in connection with Lot 1 of the Maharishi Center;

WHEREAS, boundaries of the City currently include Maharishi Center Lots 6, 7, 8, 9, 10, 11, and that portion of Lot 1 further subdivided as Mandala One Village, and the applications for voluntary annexation are for Lots 2, 3, 4, and 5, as well as the remainder of Lot 1;

WHEREAS, the overall design of the Maharishi Center—10 circular lots or “mandalas”—is the plan of City; all the lots of the Maharishi Center are subject to the same Covenants, Conditions, Restrictions, Easements, and Reservations; all the Lots are served by a common sewer system and common water system; and all lots are part of a common master planned area and share common purposes and ongoing planning;

WHEREAS, the City Attorney was requested at the November 17 meeting to provide notices of the applications for voluntary annexation as required by law and a notice was duly published in the Fairfield Ledger on November 20, 2001, and on that same date notices were sent by certified mail to Jefferson County, the City of Fairfield, Area XV Regional Planning, and applicable utilities; and

WHEREAS, the application for annexation of the 2.13-acre parcel known as 1773 Jasmine which is not part of the Maharishi Center was withdrawn by the landowner from consideration as part of the current applications leaving 440.10 acres approximately in the applications under consideration;

NOW, THEREFORE the following resolution, duly made and seconded, was unanimously adopted by the City Council:

RESOLVED, that applications for voluntary annexation of 440.10 acres approximately be approved for the territory described as follows:

Lot 1 except the portion of Lot 1 that is incorporated in Mandala One Village subdivision which subdivision is within the existing boundaries of the City, Lot 2, Lot 3 except Auditor’s parcels “A” and “B” thereof, Lot 4, and Lot 5, Maharishi Center for Perfect Health and World Peace, a subdivision in Center Township, Jefferson County, Iowa, as shown on the final plat, recorded in Drawer 3, Document 995, Jefferson County Recorder’s Office. The Maharishi Center for Perfect Health and World Peace is a subdivision lying in Sections 9, 10, 15, and 16, Township 72 North, Range 10 West of the Fifth Principal Meridian in Jefferson County, Iowa.
